The Construction Codes Act: Registering an Interest on Title

The Construction Codes Act provides local authorities with an important enforcement tool to address non‑compliance with construction standards and building orders. Where a building official issues an order under the Act and the owner fails to comply, the building official may direct the local authority to register an interest against the property title in the Land Titles Registry. This registration serves as public notice that the property is subject to an outstanding construction-related order.

Once registered, the interest runs with the land and remains binding on both the current owner and any future owners. This ensures that unresolved building code violations cannot be hidden or avoided through the sale or transfer of the property.

The interest must be discharged once the order has been complied with or the local authority has completed the required work and recovered its costs.

Registering an interest on title promotes transparency, protects public safety and encourages compliance with Saskatchewan’s construction standards.
